Relationship to the HIPAA Notice of Privacy Practices

This Privacy Policy covers information collected through https://focusonhealthpt.com/ (the “Site”). It does not cover protected health information (PHI) that we create, receive, or maintain as part of providing health care, which is governed by our separate Notice of Privacy Practices and by HIPAA, the California Confidentiality of Medical Information Act (Civil Code § 56 et seq.), and other applicable law. If a conflict exists with respect to PHI, the Notice of Privacy Practices controls. If you submit health information to us through the website (for example, in a contact form, appointment request, or secure message), that information becomes protected health information (PHI) governed by our Notice of Privacy Practices and by HIPAA, not solely by this Privacy Policy. This Privacy Policy governs only non-health information collected through the website, such as your IP address, browser type, and pages visited.

1. Information We Collect

Information you provide. Contact and appointment-request information (name, email, phone, reason for inquiry); scheduling information; and information you choose to submit through forms or messages.

Information collected automatically. Device, browser, IP address, and usage data collected through cookies and similar technologies, and analytics data about how visitors use the Site.

Please do not submit detailed medical or health information through general Site forms or unsecured email. Use secure channels for any health information.

2. Sensitive Personal Information

Some information we handle may be “sensitive personal information” under the California Privacy Rights Act (CPRA), including, where applicable, health-related information. We do not collect, precise geolocation, or account log-in credentials. We do not use an online portal, online scheduling or online payment system at this time. We use and disclose sensitive personal information only as permitted by law and as necessary to provide and secure our services, and not to infer characteristics about you for purposes the CPRA restricts. Information concerning your care is treated as confidential medical information under the CMIA and applicable California law. To the extent the California Privacy Rights Act applies to us, you have the right to limit our use and disclosure of your sensitive personal information to the purposes permitted by law; to exercise this right, contact us at (949) 851-8121 or info@focusonhealthpt.net. Information concerning your health care is governed by HIPAA and the CMIA, which provide separate and more protective rights; see our Notice of Privacy Practices.

3. How We Use Information

  • To respond to inquiries and appointment requests;
  • To operate, secure, maintain, and improve the Site;
  • To comply with legal obligations and protect our rights and the safety of our patients and staff.

4. Cookies and Tracking Technologies

We use cookies and similar technologies to operate and analyze the Site. Consistent with guidance from the U.S. Department of Health and Human Services, Office for Civil Rights, regarding online tracking technologies, we configure tracking technologies so that they do not transmit identifiable health information to third parties without authorization, and we limit third-party advertising or analytics on pages where health information may be present.

Google Analytics is used only after a visitor consents to Analytics cookies, and we do not use tracking pixels or cookies that transmit your health information, name, or email to third-party advertisers or analytics platforms.

You can control cookies through your browser settings.

The Site uses an automated consent-management mechanism that recognizes supported browser-based privacy signals, including Global Privacy Control (GPC) and Do Not Track (DNT), and limits non-essential tracking in response to those signals.

5. How We Disclose Information

We may disclose information to service providers and contractors who support the Site (e.g., website hosting, cookie-consent management, analytics, security services, secure website forms) under contracts that limit their use of information; to comply with law; and in connection with a business transition. Information submitted through our secure forms may include protected health information (PHI) and is handled in accordance with our Notice of Privacy Practices, HIPAA, and applicable law. We do not sell personal information, and we do not share personal information for cross-context behavioral advertising.

6. Your California Privacy Rights (CCPA/CPRA)

To the extent the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA), applies to us, California residents may have the right to: know/access the categories and specific pieces of personal information we collected; delete personal information (subject to exceptions, including information we must retain for medical, legal, or security reasons); correct inaccurate personal information; limit certain uses and disclosures of sensitive personal information; opt out of any sale or sharing of personal information (note: we do not sell personal information or share personal information for cross-context behavioral advertising); and not be discriminated against for exercising your rights.

We will verify your identity before responding and may request additional information to confirm your request. Where required by applicable law, we will provide the methods required to submit requests. You may use an authorized agent.

7. Children and Minors

Our Site is directed to adults. We do not knowingly collect personal information from children under 13 through the Site in violation of the Children’s Online Privacy Protection Act (COPPA). A parent or legal guardian who believes a child provided information through the Site may contact us at info@focusonhealthpt.net or (949) 851-8121 to request its removal. Any request will be handled in accordance with applicable law and any applicable health-record or other record-retention requirements.

The Site does not currently provide registered-user accounts or features that allow users to publicly post content or information. California Business and Professions Code § 22581 applies to certain content or information posted by a minor who is a registered user of a website or online service. If the Site were to provide a feature to which Section 22581 applies, an applicable removal request may be made by contacting us at info@focusonhealthpt.net or (949) 851-8121. Information submitted through a secure website form is not publicly displayed on the Site.

Information about minor patients created in the course of care is governed by the Notice of Privacy Practices and applicable law. If you are a minor who has lawfully consented to your own care under California law, privacy and access rights relating to that care are governed by applicable California and federal law. This statement describes privacy rights that may arise under applicable law and does not mean that Focus On Health offers every category of health care for which a minor may be permitted to consent without a parent or guardian.

8. Data Security and Retention

We use reasonable administrative, technical, and physical safeguards designed to protect information collected through the Site. No method of transmission or storage is completely secure. We retain information only as long as necessary for the purposes described here or as required by law. Medical records are retained for at least 7 years following discharge (longer for unemancipated minors, as required by California law — Bus. & Prof. Code § 2620.7). Patients and patient representatives have rights to inspect and obtain copies of patient records as provided by California Health & Safety Code § 123110 and other applicable law. Non-medical website data (such as IP addresses and usage logs) is retained according to the retention settings and practices of the applicable systems and service providers unless longer retention is required for legal or security purposes.
